Davies Group Limited with its registered office at 5th Floor, 20 Gracechurch Street, London, EC3V 0BG, United Kingdom, and its entities and affiliates (hereinafter referred to as ‘Davies Group’) are committed to being transparent about how the Davies Group processes your personal data.

Davies Group is committed to respecting individual privacy rights and complying with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), as well as any applicable provincial privacy legislation. This Privacy Notice explains how Davies Group, when operating in Canada, collects, uses, discloses, retains, and safeguards personal information in connection with our websites, products, and services. It is intended to help individuals understand our privacy practices and make informed decisions about their interactions with us.

In this Privacy Notice, the terms ‘we’, ‘our’ or ‘us’ are used to refer to the Davies Group, who the organization responsible for processing your personal data.

2.1 Personal Information

In this policy, “personal information” generally means any information that can be used, either alone or in combination with other information, to identify an individual. This includes information such as your name, contact details, birth date, driver’s licence number and health card information.

It may also include other types of more technical information, but only when this information can identify you as an individual.

Generally, “personal information” does not include information that is used for the purpose of communicating or facilitating communication with an individual in relation to their employment, business or profession, such as the individual’s name, position name or title, work address, work telephone number, or work email address.

2.2 The types of personal information we collect

We only collect personal information that is reasonably required to fulfil the purpose for which it was originally collected. Depending on the service provided, we collect and process the following types of personal information:

• Personal Information: Full Name, home address, phone number and email, date of birth, age, gender, marital status, nationality, citizenship status.
• Government Identifiers: Driving licence number, passport number, social insurance number.
• Property Information: Commercial and residential property information, insurance records, claims history, and photographs of the property.
• Insurance Information: Insurance policy information, claim information, application details, claims history, information collected during inspections, and property valuations, compensation claim.
• Employment-related information: Job title, department, employment dates and contract type, office location, records of employment, benefits and entitlements, working hours, and health and safety information.
• Claim-related information: which may include your insurance policy details, estimates, notes, photographs, surveillance video footage, media reports, statements, social media posts (e.g. posts about your birthday, travels, friends and family, events, whereabouts), correspondence, details of subrogation, written statements, information on alleged injuries ( e.g. the nature and extent of an injury, the name of medical providers, details regarding medical appointments, medical reports), occupation and employment information, allegations on financial losses or damages, financial records, loans, mortgages, tax records, property work orders, professional and specialist reports, first responders’ reports, property ownership records, specialist reports, invoices, prior insurance claims, settlement recommendations, agreed settlements, and, in circumstances where we believe there exists some potential for fraud or arson, information about financial motivations, debts, financial pressures, prior losses, and information about any of any outstanding and unmet obligations.
• Financial information: Bank account details, account numbers, bank statements, bonus payments, and corporate credit or debit card numbers.
• Medical Information: Medical Records, medical condition, personal Injury Information, health and safety related information.
• Education, Skills, and Professional Experience: Academic transcripts, education and training history, educational degrees, grades, languages, professional memberships, qualifications, certifications
• Travel and Expense: Expense details, travel booking details, travel history.
• Children personal information: We may collect children’s names, but only if consent has been obtained (where required) from a parent or guardian, and the information is relevant to the products and services we provide.
• Online identifiers: When you browse our website, we use cookies to collect usage data, which may include, but is not limited to, your IP address, Browser information, browsing time, cookie information, device information, IP address, network interaction history, website history, account age, account number, account password, username More information about the types of cookies we use and our reasons for using them can be in our Cookie Policy.

2.3 How We Collect Personal Information

The personal information we process may be collected from a variety of sources including, but not limited to:

• Directly from you, when you contact us.
• From an insured person. We may also collect personal information about you from an insured person in the context of a claim.
• Our business partners and clients we service, such as your insurer.
• Service providers, contractors and other vendors who provide services on our behalf.
• From specialized databases: such as databases containing information about driver licences or allowing us to conduct a media search.
• Industry regulators, including but not limited to the Privacy Commissioner’s Office in Canada provincial privacy commissioners, and relevant financial or insurance regulatory bodies.
• Law enforcement agencies.
• Your devices, such as when you use our services.
• Website cookies and similar technologies.
• Social media services.

2.4 How We Use Personal Information

Davies may use your personal information for the purpose of performing contracted services for our clients and conducting our business operations, including the uses described below.

We may use your personal information for the following purposes:

• Providing our services. We use personal information as necessary to provide and deliver our services to our clients. For instance, we may notably use your personal information for:
  • Claim adjusting, managing and processing services;
  • Pre-employment or tenancy application background checks services;
  • Whistleblowing hotline services.
  • Personal security and investigation services;
  • Forensic accounting;
  • Forensic engineering and environmental science services as well as to provide assessments of damage and determination of cause services related to incidents.
• Communicating with you. If you contact us with a question or inquiry, or if we need to communicate with you when providing our services, we may use your personal information to communicate with you in a variety of ways, including by email, telephone, SMS and direct mail. We may also communicate with you for business development purposes and to promote our services and offers. For greater certainty, we do not share SMS consent or phone numbers for the purpose of sending SMS messages with any third parties for marketing or any other unrelated purposes. Your phone number will only be used for the specific purposes for which you provided it, such as receiving communications from us directly.
• Processing job applications. If you apply for a position at Davies Group, we may use your personal information as necessary to process and evaluate your application.
• Managing our business. We use your personal information for several reasons in connection with our business operations, which may include exercising due diligence to prevent or reduce our commercial risk and to ensure the security of our information, system or network.
• For other purposes as permitted or required by law. For example, we may use the information we collect to protect the security of that information and our websites or to comply with a legal requirement, if necessary.

We may also request your consent to use your personal information for other specific purposes.  Under the Personal Information Protection and Electronic Document Act (“PIPEDA”) and other applicable privacy regulations in Canada the lawful bases we need your consent before processing your personal information.

2.5 Sharing Your Personal Information

Within the Davies Group, your personal information will be shared with team members who need to access it for the processing purposes outlined in this Privacy Notice.

We will only share your personal information with other parties where it is reasonable and necessary to accomplish the processing purposes outlined in this Privacy Notice. Where applicable, and in accordance with provincial regulations, express consent will be obtained before disclosing personal health information (PHI) or other sensitive information, as well as before using profiling technologies or automated decision-making processes. This may include (but is not limited to):

• With our service providers. We may disclose your personal information to other organizations and businesses that provide services to us for the purposes set out in this Policy, such as mandated professionals in the context of a claim, including private investigators, engineers, architects, environmental consultants, medical professionals, translators, transcriptionists, affiliates, and others. Other service providers who may be provided with personal information include professional services, communications services and mail services. We require these service providers to protect personal information with appropriate security safeguards and to limit their use of personal information to what is necessary to carry out their mandate.
• With persons or entities which we must contact to conduct a pre-employment or tenancy background check: We may disclose your personal information with the references you provided, your former employers, the schools and institutions you represented having attended and entities responsible for the credentials you listed. We may also provide your personal information with any other agencies, administrative bodies and databases which allow us to verify information about you in the context of a background check.
• With our clients: We may disclose your personal information to our clients and business partners where you have consented to such disclosures or where we are otherwise permitted do so by applicable laws.
• In the context of the sale or transfer of our business or other transaction. We may decide to sell or transfer all or part of our business to a third party, merge with another entity, secure our assets or proceed with any other financing or other strategic capital transactions (including insolvency or bankruptcy proceedings), restructuring, share sale or other change in corporate control. We may share your personal information when required for the purposes of such a transaction.
• Other permitted reasons. We may share your personal information when permitted or required by applicable law. This may be the case, for instance, if Davies Group is under a duty to disclose or share your personal information in order to comply with any legal obligation, or in order to enforce or apply Davies Group terms of use and other agreements; or to protect the rights, property, or safety of Davies Group, Davies Group customers, or others.

2.6 How Long We Keep Your Personal Information for

We store your personal information for as long as is necessary to provide our services clients and business partners, to manage our business operations, and to comply with our legal and regulatory obligations. Once no longer required, your personal information will be securely destroyed or anonymized (so that it is, at all times, reasonably foreseeable in the circumstances that the information irreversibly no longer identifies you directly or indirectly) in accordance with our Record Retention and Destruction Policy.

2.7 Cross-Border Transfers of Personal Information

In the course of providing our products and services to you, there are circumstances when we and/or one of our third-party service or hosting providers may transfer your personal information outside Quebec and outside Canada in a foreign country (such as Ireland, India, the United Kingdom, and the United States) with different privacy laws may provide a lower standard of protection for your personal information than your jurisdiction of residence.

Where such a transfer is necessary, we will only make the transfer once we can be assured that suitable protections will be maintained, and appropriate safeguards are in place. This may include:

• Ensuring that we transfer the personal information to countries that are deemed to provide an adequate level of protection.
• Putting suitable clauses in our contracts so that organizations take appropriate steps to give personal information the same protection required under applicable privacy regulations.
• Implementing suitable technical and/or organizational measures to protect the personal information.

2.8 Safeguards

To protect your personal information, we employ organizational, physical and technological safeguards. Our goal is to prevent unauthorized access, loss, misuse, sharing or alteration of personal information in our possession. The nature and level of these safeguards are proportionate to the sensitivity and format of the information collected. We also use these safeguards when we dispose of or destroy your personal information.

2.9 Automated decision-making and profiling

In some circumstances, Davies Group may use automated processing and decision-making, where a decision is made by automated means without any human involvement. Our current use of automation technologies includes:

• Robotic Process Automation (RPA) – Where virtual workers automate the copying and pasting of information from one system into another.

• Self-Service Platforms – Allows humans to directly interact with an RPA process, enabling human-in-the-loop processing of information.

• Artificial Intelligence (AI) and Machine Learning – To enable virtual workers to learn and understand the data presented and improve effectiveness.

• Intelligent Automation Digital Assistant – An AI supervisor that automatically manages, tracks, and orchestrates virtual worker schedules and activities.

• Computer Vision/Optical Character Recognition – Offers pattern matching within images and can be used to interpret complicated language-based text recognition.
• API End-points – Uses virtual workers to bridge the gap between old systems and new ones by copying and pasting information across.

We do not anticipate that any of the automation technologies described above will produce legal or similarly significant effects on you, however if this was to change in the future, we would only do so where it is:

• Necessary for the entry into or performance of a contract; and

• Authorised under domestic laws applicable to the data controller; or

• Based on your explicit consent.

2.10 Individual Access

Davies Group is committed to processing your personal data in compliance with all applicable laws and regulations. Under applicable privacy laws in Canada, you may be able to exercise several individual rights, including:

Right to Know/Access

You have the right to ask us for a copy of the personal information we hold about you, as well as other supplementary information.

Right to be Informed

You have the right to know how we will collect and use your personal information.

Right to Rectification or Correction

You have the right to ask us to rectify personal information you think is inaccurate, or to complete information you think is incomplete.

Right to Erasure

You have the right to ask us to erase your personal information, in certain circumstances. Please note – there may be certain circumstances under which we are obliged to retain your personal information.

Right to de-index for Quebec residents

Right to have your personal data de-indexed (applicable to residents of Quebec).

You have a right to ask that we stop distributing your personal data. Additionally, you may ask that we de-index your personal data if disseminating it causes you prejudice.

Right to Withdraw Consent

You have the right to withdraw your consent.  in certain circumstances. Please note – there may be certain circumstances under which we are obliged to retain your personal information.

In Quebec, where applicable, you have the right to withdraw your consent when we transfer your personal information outside the province.

Right to Data Portability for Quebec residents

You have the right to ask that we transfer the personal information you gave us to another organization, or to yourself, in certain circumstances.

Rights to object to Automated Decision-Making and Profiling for Quebec residents

You have the right to request human intervention where a decision has been taken about you using fully automated decision-making or profiling, request reasons and factors used, and parameters to use the decision corrected.  submit a request for us to disclose the use of technology that can profile you.

4. Challenging Compliance

We aim to meet the highest standards to safeguard your privacy. However, if you have any concerns about Davies Group’s use of your personal information, you can make a complaint to our Data Protection Officer by emailing dpocanada@davies-group.com.

You also have the right to contact the appropriate Privacy Commissioner of the jurisdiction of your province or territory of residence. Some activities are subject to the Office of the Privacy Commissioner of Canada (OPC) data protection regulator if you feel that we have processed your personal information in a manner which contravenes privacy law.
